Feedback is now open on a draft Bill to amend the Independent Commissioner Against Corruption Act 2017.

The Exposure Draft Bill has been developed following public feedback in response to the Discussion Paper for the Review into the Independent Commissioner Against Corruption Act 2017, conducted by Mr Greg Shanahan PSM, which closed in 2022.

The purpose of the Exposure Draft Bill is to ensure that the ICAC has sufficient powers in line with modern practice to meet public expectations. In doing so, the reform seeks to ensure there is an optimal legislative framework for integrity in Government, whilst protecting the rights of individuals, and the justice system more generally. The Exposure Draft Bill proposes amendments to the Act and associated legislation under the following key areas:

1. Jurisdiction of the ICAC

2. Whistleblowers, witnesses and proceedings

3. ICAC enforcement powers and other operational matters

4. ICAC Inspector

5. Journalist privilege

6. Technical amendments

Making a submission

Lodge your written submission by email to CMCLegalPolicy@nt.gov.au.

Written submissions will be accepted until 4pm Monday 12 June 2023.

A submission may be made in relation to some or all aspects of the Bill.

A Guidance Paper has been developed to assist in understanding the exposure draft Bill.


Non-confidentiality of submissions

To maintain the confidentiality and identity of those who wish to provide feedback, submissions will not be made publicly available.
The Department may draw upon the contents of submissions made and quote from them or refer to them in reports, which may also be made publicly available.

Note: This consultation relates to issues of a general nature pertaining to the Exposure Draft Bill. Any formal complaints or reports relating to conduct under the jurisdiction of the ICAC should be directly provided to the ICAC. Any specific complaints received about the Commissioner and his Office will be not be investigated as part of this process, and should be referred to the ICAC Inspector.
